How we work together.

OrcaShift is a subscription-based workforce scheduling platform (“Service”) that enables businesses (“Owners”), their managers (“Managers”), and employees (“Employees”) to create, manage, and view work shifts, handle leave requests, and coordinate team schedules.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible.

To use OrcaShift you must:

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Do not share your password or allow others to access your account.

Owner accounts are created by business owners who complete onboarding. Manager and Employee accounts are created by invitation only.

You must notify us immediately if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your credentials.

OrcaShift is offered on a paid subscription basis following a free trial period. Pricing is determined by the number of employees in your business unit and your chosen billing cycle (monthly or yearly).

Violation of these rules may result in immediate termination of your account.

You retain ownership of all data you and your team enter into OrcaShift (“Your Data”). By using the Service you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service to you.

We do not sell Your Data or use it for advertising. Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

You are responsible for ensuring you have the right to upload any personal data belonging to your employees and that you have complied with applicable data protection laws, including obtaining any necessary consents.

OrcaShift and all related technology, designs, trademarks, and content are and remain the exclusive property of OrcaShift. Nothing in these Terms grants you any right to use our name, logo, or other brand assets without our prior written consent.

Feedback or suggestions you provide about the Service may be used by us without restriction or compensation.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

We are not responsible for any scheduling errors, missed shifts, or workforce decisions made using information displayed in OrcaShift. You remain responsible for all management decisions within your organisation.

To the maximum extent permitted by law, OrcaShift shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim under these Terms shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

You may delete your account at any time in Settings → Account & security. We may suspend or terminate your account if you breach these Terms, fail to pay your subscription, or if we reasonably believe your use poses a risk to other users or the Service.

Upon termination, your access to the Service will cease. We will delete your data in accordance with our Privacy Policy and any legal retention obligations.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the country where OrcaShift is registered, unless otherwise required by local law.

We may update these Terms from time to time. We will notify you of material changes via the app or by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
